As one of the benefits of therapistinsurance.ca insurance policyholders, Holman Insurance Brokers Ltd. has an arrangement for all our Canadian-based policyholders to provide a helpful pro bono medico-legal advice line (by telephone or e-mail) relating to a number of key business issues our client may face including clinical risk management, contractual liability and potential liability issues that could have an impact under this policy.
It is important to note that this advice line is exactly that, a point of reference for our policyholders in the event that they feel that they need professional legal advice. The advice line is a free service, which is envisaged to take the form of a telephone conversation or e-mail communication to provide some initial free advice to policyholders to assist them with medico-legal issues, and to allow them to make a more informed decision on what to do next.
The advice line is not intended to go as far as to provide case specific research or review documents. It is however intended to cover a broad range of issues such as:
• Complaints, Claim(s) or matters which may trigger cover under this insurance policy
• Investigations against any medical practitioners working for/on behalf of the Insured
• Patient consent
• Disclosure of records or information (including via reports or witness statements)
• Confidentiality and data protection issues
• Child protection and vulnerable adult issues (including concerns about sexual and other abuse)
• Reporting to any Healthcare Regulators about incidents or individuals or other organizations
• Mental health and mental capacity concerns
• Human Rights Act issues
• Professional obligations and Ethical obligations, opt-out rights (e.g. conscientious objection to abortion)
